This is the privacy policy and statement ("privacy policy") for Diteramb Consult LTD ("DC"). By using the Ecognise website and purchasing from it you accept the terms of this privacy policy. 

 

Commitment to Privacy

This privacy policy explains how Diteramb Consult Ltd (referred to as  “DC”, "we", "us" or "Ecognise") collects information from you via the Ecognise website or in any manner expressly described in the privacy policy and how this information is then used. When you provide us with your personal data you consent to us processing all such personal data as set out in the privacy policy.

This notice provides a summary of the full privacy policy and applies to information collected by DC via the Ecognise website www.ecognise.com and in any manner described in the privacy policy. 

This privacy policy describes how we treat personal data received about you when you visit the Ecognise website, e-learning environment or otherwise (the "website"). Please read this privacy policy carefully, because by visiting or using the Ecognise website or contracting with us, you agree to its terms. This privacy policy applies only to the Ecognise website, and not to the websites or e-learning environments of other DC companies.

We may revise this privacy policy from time to time. We recommend that you re-read this privacy policy for updates or any important changes. Please check the privacy policy, because your continued use of the Ecognise website after we post the change means you have agreed to the new terms.

 

Collection of Personal Data

We collect personal data about you when you enroll in a training academy. At enrolment, we may ask you for sensitive personal data and for your consent to use it for a specific purpose. If you do not wish to provide this information, you will not be able to purchase courses on the website. 

We share some of your personal data with the employer, who may have sponsored your course. In case that the employer has sponsored your course, the employer is entitled to access individual participation and achievement data and see your results. DC will share your participation and achievement data with other organizations if you tell us that you are happy for DC to do so.

When you access your academy materials we collect information about how you use those materials but we do not use tagging methods.

You do not provide us with personal data when you use one of our online skills tests.

We use cookies and other technologies to keep track of how you interact with our website and to target advertising.

We collect your personal data when you ask for information about our training academies, when you submit your  answers to our assessment quizzes or surveys, or when you enroll or are enrolled in one of our courses and use our training products or order training materials.

To process your enquiries and assessment quizzes or surveys, we collect your name, email and postal addresses, daytime phone number, and, if applicable, company and work position.

To process enrolments and orders, we may ask for your name, email and postal addresses, daytime phone number, company name and address.

DC may also use your postal and email addresses to send you information about other education or training, and other services or products similar to those you have ordered from us, or to send you an invitation to solicit such information from our sibling DC educational company. 

If you do not wish us to send you this additional information, you can let us know by phone or by email.

 

Sharing Data

We will need to use your data to perform our obligations and exercise our rights under agreements made with you and to inform you of feedback and study results.

If you have enrolled in our training courses through your employer, we may share your data, course attendance, and study and test results with your employer.  Such third parties are not subject to this privacy policy. Contact these companies directly for information about how they treat your personal data.

Otherwise, we will share your personal data only with the service providers who host or help us run the Ecognise website or fulfill your requests. These other companies may be supplied with or have access to your personally identifiable information solely for the purpose of providing these services to us or on our behalf. We may also need to disclose your personal data to third parties when we, in our sole discretion, believe it is necessary to comply with the law, to enforce our user agreement or this privacy policy, or in connection with a sale or transfer of DC´s business.

When you give us information about another person, the other person must have agreed to let: us process all their personal data; you receive any data protection notices for them.

When you send information for someone else, you are confirming that you have told them: which data they must give; which information is voluntary; and how they can access and, if necessary, correct the data we hold about them.

 

Purposes and Disclosures

We use your personal information to deal with your queries, to provide you with the services you request, for general statistics and research.

Depending on the preferences indicated by you, we might use your personal data to contact you about DC and Ecognise developments and offers and for customer feedback.

We may disclose your personal data to your employer, if you are being sponsored by your employer or by a trade organisation or other group. We may disclose your information to third parties who may take over some or all of the DC business in the future.

We will disclose your personal data to the approved trainer that will be delivering and supporting your lessons and courses (who may use it for any of the above purposes). Following registration and enrolment all of our approved trainers will have access to your name, user reference number and details of which Ecognise courses you have enrolled on in the past. The trainers do not have any access to your test results and the stage of your study. Any email communication and exchange data between you and your trainers is not part of this privacy policy and agreement.

 

Your ability to choose

We may use your email or postal address to send you information on other services or products we or other DC companies think might interest you. If you do not wish to receive such information from us or other DC companies, or you do not wish us to share your data in this manner, you can let us know by emailing us at or sending your request by post.

You can request that: your details are not used for marketing purposes; and we correct inaccuracies in your information.

You may also turn cookies off in your browser. However if you do so, you may not be able to use certain features on the Ecognise website.

 

Data Protection Laws

Your personal data is protected by EU data protection law.

 

Data Collection During Enrolment 

When you enroll with us, you (or the person enrolling you) must tell us: your full name; your address (and correspondence address if different); and incidentally: where you heard about us; and if you have done any training with us in certain periods.

We also request other incidental information, but you don't have to give us these details. Following enrolment via the Ecognise website, we, or our approved trainers, may request additional personal data from you in order to further support your training. You do not have to provide this information, but if you do not, you may not get the most out of your training course or lessons. 

Before you enroll, we will give you a username and ask you for a password. You will also be given an Ecognise reference number.

 

Using Collected Information 

We use your personal information and your Ecognise profile: to answer your queries or complaints; to deliver our services, for example on-line tools to test your skills; to provide the Ecognise community facility; to be able to offer you courses at the reduced price; to support your training; to provide course materials; to carry out administration; to improve the quality of DC and Ecognise services; to support your application and registration; for general statistics and research; for obtaining any relevant professional advice as may be required by law or in connection with legal proceedings (including where we intend to take legal proceedings), or as may be necessary to establish, exercise or defend our legal rights.

 

Sensitive Personal Data

Sensitive personal data includes details of your: race or ethnic origin; political opinions; religious or other beliefs; trade-union membership; physical or mental health; sexual life; or criminal record (including information about criminal proceedings and suspected criminal activities).

At or before enrolment you may be asked for sensitive personal information but you do not have to provide it. Where we invite you to provide such information, we will ask you to consent to our proposed uses of such data. If you do not wish to provide this information you can simply do so and will not be part of additional Ecognise activities.

You may also volunteer sensitive personal data to our approved trainers, for example, or us when you submit a query or comment to us via the website or some other means of communication. If you do so, you explicitly consent to our using such information as described in this privacy policy.

Gathered Information when You Browse the Ecognise Website Although we will do all that we reasonably can to ensure that availability of our website will be uninterrupted and error free, we cannot guarantee this due to the nature of the internet. The Ecognise website may also be down from time to time to allow us to maintain or repair it, or to change the services that we offer.

When you visit the Ecognise website to browse information that it contains, you do so anonymously unless you choose to provide us with information about yourself. If you do nothing during your visit but browse through the web site - reading pages, viewing images, watching video for example - we will gather and store certain information about your visit automatically. This information does not identify you personally. Information gathered automatically is used for only two purposes: site management and, in the case of suspected unauthorized activity, for law enforcement and possible criminal prosecution.

The Ecognise website automatically logs visitor information from which summary statistics are created. We use the summary statistics to help us make our site more useful to visitors, such as assessing what information is of most interest to visitors, as well as for other purposes such as determining the Ecognise website's technical design specifications and identifying system performance or problem areas.

The following are representative of the types of information automatically collected and stored about your visit: Internet domain and Internet Protocol (IP) address from which you access our website; the type of Internet browser and the operating system of the computer you use to access our website; the date and time of your visit; the pages you visit on our website; if you linked to our website from another one, the address of the other website; and, if you linked to our website from a search website, the address of that website and the search term you used.

 

Other Collected Information 

If you require a free information pack, we ask you to provide us with the information on the "request more information" form in the contact section of the website, including: full name; full address; an indication of training courses in which you are interested; and where you heard about us.

You can also decide to give us your home and mobile telephone numbers but you only need to do this if you want us and/or our approved trainers and provider to contact you about DC and Ecognise developments and offers in this way.

If you are not registered as a user or a trainee you cannot use one of our online tests to test your skills. We ask you to provide your full name and email address to register and this information is retained by us but is used only when sending you your test results. You may also provide personal data through: telephone calls to DC; letters and email; customer feedback forms; the Ecognsie community; or other DC or Ecognise facility offered by us.

We do not record or store calls to our help lines. We keep calls for confidential. In general, if you contact us, we may keep a written record of your query or complaint for a reasonable time in case you contact us again.

 

Third parties 

To achieve the purposes set out in this privacy policy we may need to share your information with our service providers and approved trainers, agents, professional advisors and auditors. When you enroll on a course, you will know, who of the approved trainers will be delivering and supporting your training. Following enrolment via the website, all of our approved trainers will have access to your username, and which lessons and training courses you have enrolled on to help us deliver our services to you.

We may also give your information to third parties who may take over part or all of the DC’s and Ecognise business in the future, but only for the purposes outlined in this privacy policy. If your employer, trade organisation or other organisation is sponsoring or supporting you, we may give the personal information we have collected to your sponsor to monitor your learning.

Communications between you and your trainer using any of the tools or functions we make available to you (including unopened messages sent via our messaging system) may be monitored by DC’s staff to check the quality of trainer support. DC’s staff and auditors may also access these communications when we want to investigate or audit DC and Ecognise finances. 

 

Keeping you Informed

We, and our approved trainers, will use your information to send you regular updates about: our services and materials; additions to the website; and specific activities such as customer feedback surveys and competitions.

If you do wish to receive information about Ecognise developments and DC offers by email, please invite us to contact you. You can change your Ecognise profile at any time by using "edit details" on your Ecognise user page.

You can invite us to send you updates by ticking "request more information" page. If you change your mind about us contacting you for this purpose email us at office@ecognise.com .

We will never use your sensitive personal data for marketing purposes or to target you for customer feedback purposes without your express consent.

 

Statistics

We or the approved trainers or provider delivering and supporting your training are also required to provide statistics to employers, funding your training. They can carry out checks on your and our performance and for research and statistical purposes. This helps us, and our trainers and provider, to maintain good relationships with the sponsors of your training. Where such information is supplied, it is provided in an aggregated manner so that whilst such companies may be aware of, for example, the geographic location of persons using Ecognise, you cannot be personally identified from this information. You will not be identifiable from the statistical information compiled. 

If you have not registered and are simply making an enquiry or request for information, we will use your personal information to reply to your enquiry or request for information. We will not use this information for marketing purposes without your permission or unless you invite us to do so.

 

Protecting Personal Information

We take appropriate technical measures to protect your personal information including making a regular backup of our system and data. We have security measures in place to make sure any personal information we collect is secure. However, your password can only be changed by you and cannot be seen by anyone. All parties with access to your information are subject to confidentiality obligations. If you think someone else knows your password, or is using it, tell us immediately and change your password using the "change my password" option under "your details" on the Ecognise website.

Even though we take appropriate technical steps to protect your security, you should remember that data transmission over the internet cannot always be guaranteed as 100% secure so you use the Ecognise website at your own risk.

We may employ cookie technology to estimate our total audience size and traffic and to help us improve our website's experience by measuring which Ecognise website areas are of greatest interest to users. 

You can turn off the ability to receive any of these cookies by adjusting the browser in your computer, but you should note that if you do so, this may materially affect the functionality of the Ecognise website and the information you can access through it. 

We also use cookies to: cut down the number of times you have to type in data; record the success of advertising, to target advertising and to track any visitor usage; and track responses to regular customer surveys and to make sure you don't see the same survey more than once.

The cookies used on the website do not collect your personal information.

We do not issue the cookies used in third party online surveys, such cookies may require your browser to connect to sites that are not run by us. We use cookies to identify registered users automatically when they log on and also to track users as they travel through the system. If you disable cookies you will not be able to log in to the Ecognise website or add an item to the shopping basket.

Some of our web pages may contain invisible electronic tags that allow us count users that have visited certain pages. These files are only used to identify which advertisements bring customers to our website and you cannot be identified by them. They are not issued by us but by the relevant advertising provider. Transfer of Data Outside of the EU

Your information may be stored, processed and accessed in the United States or any other countries where DC has facilities. By using the Ecognise site, and the DC services, you consent to the transfer of information outside your country.

 

Policy for Children

Our website is not designed for or directed at children under the age of 13. Following registration, a payment is required and your children are not able to follow courses if they have not paid. We are unable to see birth dates of individuals. We recommend that you put parental controls on your Internet browser and supervise your children when they are online. We will not use information collected from people under 18 for marketing purposes. 

 

Shared Information with Other DC Businesses

Any information that you may provide to DC can be shared with other DC businesses in order to fulfill your information needs about products or services of those other DC businesses in which you register an interest.  Such information may include your contact details (if you have requested us to contact you in this regard). 

We will not pass any information to any party outside the DC, although we reserve the right to pass your details to law enforcement agencies if required to do so by applicable law. 

If the assets of DC are sold we reserve the right to pass your details to the new purchaser, subject to notifying you of this as soon as is reasonably possible in the case of an asset sale. You should note that if our business (or any part of it) is sold or transferred at any time, the information we hold may form part of the assets transferred although will still only be used in accordance with this privacy policy.

Any changes to our privacy policy will be posted here although we may choose to email you directly or direct you to an updated policy when you visit our Ecognise website if the changes are significant.
